NORTH MYRTLE BEACH, S.C. -- The North Myrtle Beach City Council met in a regularly scheduled meeting on November 7, 2022, at 7 p.m.

Prior to the regularly scheduled meeting, council members held an executive session to discuss the following items. No votes were taken.

1. A legal briefing regarding Johnson Street.
2. A legal briefing regarding weight limitations for bridges.
3. A legal briefing regarding Fire Codes 1006.2.1 - Egress based on occupant load, 1006.3.3-Single exits, and 1028.5-Access to a public way.  

During the regularly scheduled meeting, Council Members approved minutes from a City Council meeting on October 18, 2022.

Mayor Marylin Hatley proclaimed the week of November 12-18, 2022, as Community Foundations Week. The Mayor also proclaimed November 26, 2022, as Small Business Saturday. Also, December 2, 2022, was proclaimed Arbor Day in the City of North Myrtle Beach.

The items below were approved on the consent agenda:

1. RESOLUTION: Regarding the conversion of Johnson Street from a private right-of-way to a public right-of-way. (APPROVED)
2. RESOLUTION: Approving an annual assessment report and updated assessment roll for the Cherry Grove Improvement District. (APPROVED)
3. MOTION TO APPROVE: “Over the Edge” event. (APPROVED)
4. ORDINANCE/SECOND READING: Affirm the 2006 decision of City Council to abandon the current location of Crescent Beach Access #8 in exchange for its relocation approximately 66 feet southward with improvements. (APPROVED)

Several unfinished business items were also approved:

1. ORDINANCE/SECOND READING: An ordinance regarding the Municipal Assessment Bonds, Series 2022 for the Cherry Grove Improvement District (a.k.a. Cherry Grove Dredging Project). (APPROVED. Council Members voted to accept changes that were made to the ordinance).
2. ORDINANCE/SECOND READING: Amendment to the Parkway Group Planned Development District (PDD) regarding the Apache Lakes Townhomes. (APPROVED. Updated elevations and color palettes were provided to Council Members as requested by the developer).
3. ORDINANCE/SECOND READING: An ordinance regarding the Separate and Independent Amendment to the Master Development Agreement of the Parkway Group PDD known as the Apache Lakes Townhomes and to authorize the City Manager to sign the document on behalf of the City. (APPROVED. Mayor Marilyn Hatley commented on how the developer was paying enhancement fees to help pay for public safety, including a new fire station on the west side of the Intracoastal Waterway).
4. ORDINANCE/SECOND READING: Creating the Third Amendment to the Sandridge Tract Development Agreement and authorize the City Manager to sign the document on behalf of the City. (NOTE: Council approved a request from the petitioner to postpone second reading. A new date for the second reading was set for the regularly scheduled City Council meeting on December 5, 2022).

Several new items on the agenda were also approved and three public hearings were held:

1. ORDINANCE/FIRST READING: Petition for Annexation and Zoning Designation for 3.28 acres on Highway 90. (APPROVED. Mayor Marilyn Hatley recused herself from the vote. There were no comments from the public).
2. ORDINANCE/FIRST READING: Amendments to Chapter 20, Land Development Regulation, of the Code of Ordinances of North Myrtle Beach, South Carolina regarding wetland water quality buffers. (APPROVED. Council members discussed how the ordinance would protect wetlands in the North Myrtle Beach Community. During the public comment period, one person, representing real-estate agents, suggested the ordinance would limit development projects).
3. ORDINANCE/FIRST READING: Amendment to the Barefoot Resort Planned Development District (PDD) regarding Dye Club Villas. (APPROVED. Mayor Marilyn Hatley and Council Member Nicole Fontana, commented on how the development project dropped from 132 multi-family units to 21 multi-family units).
4. SECOND PUBLIC HEARING: Regarding the amendment to the Barefoot Resort Development Agreement regarding the Dye Club Villas. (There were no comments from the public during the hearing).
5. ORDINANCE/FIRST READING: Amendment to the Barefoot Resort PDD Development Agreement regarding the Dye Club Villas and to authorize the City Manager to sign the document on behalf of the City. (APPROVED)
6. ORDINANCE/FIRST READING: Amendment to the Parkway Group Planned Development District (PDD) regarding the Preserve. (APPROVED. Representatives for the developer asked to have a workshop with City Council Members. Council scheduled the public workshop for November 16, 2022, at 1:30 p.m.)
7. SECOND PUBLIC HEARING: Regarding the amendment to the Parkway Group PDD Development Agreement regarding the Preserve. (There were no comments from the public during the hearing).
8. ORDINANCE/FIRST READING: Amendment to the Parkway Group PDD Development Agreement regarding the Preserve and to authorize the City Manager to sign the document on behalf of the City. (APPROVED)
9. ORDINANCE/FIRST READING: Petition for annexation and zoning designation for 221.42 acres off Water Tower Road and Long Bay Road. (APPROVED. Council Member Bubba Collins and Council Member Hank Thomas suggested a workshop with developers to discuss the project further. The difference between Horry County zoning and North Myrtle Beach zoning regulations were discussed. Council members agreed to have a workshop to discuss the project. The workshop is scheduled for November 16, 2022, at 1:30 p.m.)
10. SECOND PUBLIC HEARING: Regarding the 221.42 acres off Water Tower Road and Long Bay Road known as the Lauret Associates Tract Development Agreement. (There were no comments from the public. Council members noted that the developer would spend $3.3 million to pay for various road improvements on Long Bay Road and Water Lilly Road to provide an alternate route to and from the property other than Water Tower Road. The $3.3 million for road improvements would be in lieu of $2.6 million to pay the Park Enhancement Fee, Beachfront Parking Fee, and the Public Safety Enhancement Fee).
11. ORDINANCE/FIRST READING: Regarding the Lauret Associates Tract Development Agreement and authorize the City Manager to sign the document on behalf of the City. (APPROVED)
